VOORWAARDEN

ALGEMEEN

TortAventura behoudt zich het recht voor om te allen tijde en zonder mededeling de inhoud van deze website te wijzigen of te actualiseren of de wijze van presentatie aan te passen.

BESTELLEN

  • Je kunt 24 uur per dag, 7 dagen per week geheel vrijblijvend een offerte aanvragen via het contactformulier. Graag zo ver mogelijk van tevoren, de agenda is snel volgeboekt.
  • TortAventura doet haar uiterste best om zo spoedig mogelijk te reageren.
  • De datum wordt pas voor je gereserveerd nadat je akkoord bent gegaan met de offerte.

ONTWERP

  • Eventuele aanpassingen of wijzigingen in thema, ontwerp of smaak dien je z.s.m. door te geven.
  • TortAventura behoudt zich te allen tijde het recht voor om het ontwerp naar eigen inzicht aan te passen of te veranderen.
  • TortAventura blijft eigenaar van het ontwerp en het beeldmateriaal en behoudt daarmee het recht om het beeldmateriaal van het ontwerp op welke manier dan ook te publiceren.

AANSPRAKELIJKHEID

  • TortAventura maakt gebruik van producten als: cacao, melkeiwit, lactose, tarwe, melk, soja, noten, gluten en maïs. TortAventura is niet aansprakelijk voor eventuele allergieën en problemen voortkomend uit dit feit.

ONMACHT

  • TortAventura behoudt zich het recht voor bij ziekte, letsel of zwaarwegende (privé)omstandigheden de opdracht te annuleren, uit te stellen of derden in te schakelen. Uiteraard zal TortAventura je hiervan op de hoogte stellen en proberen een passende oplossing te vinden.

VERVOEREN

  • Taarten kun je afhalen in Geldrop (bij Eindhoven). Bij het afhalen van de taart is het vervoer voor eigen risico. TortAventura zorgt ervoor dat de bestelling stabiel, goed verpakt en vervoersklaar is.
  • TortAventura zal je altijd adviseren in de wijze waarop vervoerd dient te worden. Het algemene advies luidt hierbij: de vloer van de auto of (lege) kofferbak is de meest stabiele plek. Op schoot, achterbank of stoel, kan de taart ernstig beschadigen (bijv. inzakken of verschuiven).

BEWAARADVIES

  • TortAventura is niet aansprakelijk indien je anders hebt gehandeld dan het bewaaradvies dat je gegeven is.

KLACHTEN

  • Indien je klachten hebt over het geleverde product dien je dit binnen 24 uur kenbaar te maken en bewaar je een stuk van het product. TortAventura zal dan je klacht beoordelen en aan een passende oplossing werken. Klachten die later dan 48 uur na ophalen worden ingediend kunnen niet in behandeling worden genomen.
  • TortAventura is niet aansprakelijk voor onjuiste en/of onvolledige verstrekte gegevens.

TortAventura verwerkt je persoonsgegevens doordat je bestellingen plaatst en/of omdat je deze zelf verstrekt.

WELKE GEGEVENS

Het betreft de volgende persoonsgegevens:

  • Voor- en achternaam
  • E-mailadres
  • Overige persoonsgegevens die je actief verstrekt in het online contactformulier, per chat, e-mail, telefonisch en/of in overige correspondentie

VOOR WELKE DOELEINDEN

TortAventura verwerkt je persoonsgegevens voor de volgende doelen:

  • Ontvangen van bestellingen
  • Bevestigen van bestellingen
  • Contact op te kunnen nemen om bestellingen uit te kunnen voeren
  • Offertes aan te maken en te versturen

HOE LANG BEWAARD

De gegevens die je invult in het online contactformulier worden doorgestuurd naar info@tortaventura.com en blijven als e-mail in het archief. Dit geldt ook voor e-mail die rechtstreek wordt gestuurd. Offertes worden gemaakt in een boekhoudprogramma en blijven bewaard.

DELEN VAN PERSOONSGEGEVENS

TortAventura verstrekt uitsluitend aan derden en alleen als dit nodig is voor de uitvoering van een overeenkomst met jou of om te voldoen aan een wettelijke verplichting.

GEGEVENS INZIEN, AANPASSEN OF VERWIJDEREN

Je hebt het recht om je persoonsgegevens in te zien, te corrigeren of te verwijderen. Daarnaast heb je het recht om je eventuele toestemming voor de gegevensverwerking in te trekken of bezwaar te maken tegen de verwerking van je persoonsgegevens door TortAventura en heb je het recht op gegevensoverdraagbaarheid. Dat betekent dat je een verzoek kunt indienen om de persoonsgegevens waarover TortAventura beschikt in een computerbestand naar jou of een ander, door jou genoemde organisatie, te sturen. Je kunt een verzoek tot inzage, correctie, verwijdering, gegevensoverdracht van je persoonsgegevens of verzoek tot intrekking van je toestemming of bezwaar op de verwerking van je persoonsgegevens sturen naar info@tortaventura.com. Om er zeker van te zijn dat het verzoek tot inzage door jou is gedaan, vraagt TortAventura je een kopie van je identiteitsbewijs met het verzoek mee te sturen. Maak in deze kopie je pasfoto, MRZ (machine readable zone, de strook met nummers onderaan het paspoort), paspoortnummer en Burgerservicenummer (BSN) zwart. Dit ter bescherming van je privacy. TortAventura reageert zo snel mogelijk, maar uiterlijk binnen vier weken, op je verzoek. TortAventura wil je er tevens op wijzen dat je de mogelijkheid hebt om een klacht in te dienen bij de nationale toezichthouder, de Autoriteit Persoonsgegevens.

PERSOONSGEGEVENS BEVEILIGEN

TortAventura neemt de bescherming van je gegevens serieus en neemt passende maatregelen om onrechtmatig gebruik en verlies tegen te gaan.

COOKIES

De TortAventura website maakt gebruik van zogenoemde cookies. Cookies zijn tekstbestanden die op je computer worden geplaatst.

Functionele cookies:
Functionele cookies zorgen ervoor dat de website correct kan functioneren. Denk bijvoorbeeld aan de functionaliteit om een filmpje af te spelen of van taal te kunnen wisselen.

GENERAL

TortAventura reserves the right to change or update the content of this website or to change the presentation method at any time and without notice.

ORDER

  • You can request a quote 24 hours a day, 7 days a week via the contact form. Please do this as far in advance as possible, the agenda is fully booked quickly.
  • TortAventura will try to respond as quickly as possible.
  • Only after you have agreed to the quote, the date will be reserved for you.

DESIGN

  • You must notify any adjustments or changes in theme, design or taste as soon as possible.
  • TortAventura reserves the right to modify or change the design at any time at its sole discretion.
  • TortAventura retains ownership of the design and imagery and thus reserves the right to publish the design imagery in any way.

LIABILITY

  • TortAventura uses products such as: cocoa, milk protein, lactose, wheat, milk, soy, nuts, gluten and corn. TortAventura is not liable for any allergies and problems arising from this fact.

INCAPACITY

  • TortAventura reserves the right to cancel, postpone or engage third parties in the event of illness, injury or compelling (private) circumstances. Of course TortAventura will inform you of this and try to find a suitable solution.

TRANSPORTATION

  • Cakes can be collected in Geldrop (near Eindhoven). Transport is at your own risk when collecting the cake. TortAventura ensures that the order is stable, well packaged and ready for transport.
  • TortAventura will always advise you on how to transport your cake. The general advice is: the floor of the car or (empty) trunk is the most stable place. On your lap, back seat or seat, the cake can be seriously damaged (eg collapse or shifting).

STORAGE ADVICE

  • TortAventura is not liable if you acted differently from the storage advice you have been given.

COMPLAINTS

  • If you have complaints about the delivered product, you must make this known within 24 hours and keep a part of the product. TortAventura will then assess your complaint and work on an appropriate solution. Complaints that are submitted later than 48 hours after collection cannot be processed.
  • TortAventura is not liable for incorrect and/or incomplete provided information.

TortAventura processes your personal data because you place orders and/or because you provide them yourself.

TortAventura processes your personal data for the following purposes:

  • Create and send quotes

HOW LONG KEPT

The information you enter in the online contact form will be forwarded to info@tortaventura.com and will remain in the archive as e-mail. This also applies to e-mail sent directly. Quotations are made in an accounting program and are saved.

SHARING OF PERSONAL DATA

TortAventura only provides to third parties and only if this is necessary for the execution of an agreement with you or to comply with a legal obligation.

VIEW, ADJUST OR DELETE DATA

You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your consent to the data processing or to object to the processing of your personal data by TortAventura and you have the right to data portability. This means that you can submit a request to send the personal data that TortAventura has in a computer file to you or another organization mentioned by you. You can send a request for access, correction, deletion, data transfer of your personal data or request for cancellation of your consent or objection to the processing of your personal data to info@tortaventura.com. To ensure that the request for access has been made by you, TortAventura asks you to send a copy of your ID with the request. Make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and citizen service number (BSN) black in this copy. This is to protect your privacy. TortAventura will respond to your request as quickly as possible, but no later than within four weeks. TortAventura would also like to point out that you have the opportunity to file a complaint with the national supervisory authority, the Dutch Data Protection Authority.

TortAventura takes the protection of your data seriously and takes appropriate measures to prevent unlawful use and loss.
